It replaces the cash register receipt accompanying the invoice!<\/strong><\/h3>\n<p>According to the Communications Regulation Commission, Econt Express Ltd and Speedy JSC are licensed postal operators. AZIMUTH &#8211; 6000 Ltd has a contract in place for the payment of amounts collected via cash on delivery through postal money transfer (to a bank account). For this reason, <span>the cash register receipt is replaced by a postal money transfer receipt issued by the courier.<\/span><\/p>\n<p>Pursuant to Art. 3, para. 1 (Suppl. \u2013 State Gazette, issue 49 of 2010, in force from 29.06.2010, amend. \u2013 State Gazette, issue 48 of 2011, in force from 24.06.2011) of Ordinance N-18\/2006, every person is obliged to register and report the sales of goods or services made by them in or from a commercial outlet by issuing a fiscal cash register receipt from a fiscal device (FD), <strong>except where payment is made by credit transfer, direct debit or cash money transfer<\/strong>, carried out through a payment service provider within the meaning of the Payment Services and Payment Systems Act, and\/or by postal money transfer carried out through a postal operator licensed to perform postal money transfers within the meaning of the Postal Services Act (PSA).<\/p>\n<div id=\"wrapper\">\n<section id=\"section\">\n<div class=\"inner-wrapper\">\n<div id=\"main\" class=\"left\">\n<article class=\"single-post\">\n<div class=\"post-container\">\n<h3><strong><span>What is the difference between cash on delivery and cash on delivery with a postal money transfer, and when does the obligation to issue a fiscal cash register receipt arise?<\/span><\/strong><\/h3>\n<p><span>The Postal Services Act provides a definition of the concept of<\/span><em><span> &#8221;cash on delivery&#8221; <\/span><\/em><\/p>\n<p><span>Pursuant to \u00a71, item 12 of the Supplementary Provisions of Ordinance No. N-18 of the Ministry of Finance of 13.12.2006<\/span><\/p>\n<p><em><span>&#8220;cash on delivery&#8221; is a postal service whereby the postal item is delivered to the recipient against payment of an amount determined by the sender.<\/span><\/em><\/p>\n<p><span>The supplier of the goods hands them over to the courier, who in turn is obliged to deliver them to an address specified by the customer and is obliged to collect the amount determined by the supplier for the delivered goods. The courier collects the amount determined by the supplier. Subsequently, depending on the contract concluded between the courier company and the supplier, the courier either pays the collected amount to the sender in cash or transfers it to them by bank transfer. <\/span><\/p>\n<p><span>The way in which the courier pays the amount to the sender has nothing to do with the way in which the recipient of the goods pays their value. In both cases the customer pays the amount to the courier in cash, i.e. at the moment the goods are handed over by the courier to the recipient, the payment covering their value leaves the company&#8217;s cash desk.<\/span><\/p>\n<p><strong><span>The way in which the courier pays the collected amount to the sender is decisive in complying with the statutory requirements for issuing a fiscal receipt<\/span><\/strong><\/p>\n<p><span>Pursuant to Art. 118, para. 1 of the VAT Act, every person registered and not registered under this Act is obliged to register and report the supplies\/sales made by them at a commercial outlet <strong>by issuing a<\/strong><strong>fiscal receipt <\/strong>from a fiscal device (fiscal voucher) or <strong>by issuing a receipt<\/strong> from an integrated automated system for management of commercial activity (system voucher), regardless of whether another tax document has been requested. The recipient is obliged to receive the fiscal or system voucher and to keep it until leaving the outlet.<\/span><\/p>\n<p><span>Ordinance No. N-18 of the Ministry of Finance of 13.12.2006 sets out the procedure and manner for registering and reporting sales at commercial outlets through fiscal devices.<\/span><\/p>\n<p><span>Art. 3 (1) of Ordinance No. N-18 states that every person is obliged to register and report the sales of goods or services made by them in or from a commercial outlet by issuing a fiscal receipt from a fiscal device or a receipt from an IASMCA<\/span><span>, <\/span><u><span><strong>except where the payment is made by<\/strong><\/span><\/u><span> depositing cash into a payment account, credit transfer, direct debit or cash money transfer carried out through a payment service provider within the meaning of the Payment Services and Payment Systems Act, <\/span><u><span>or<\/span><\/u><u><span> by postal money transfer carried out through a postal operator licensed to provide postal money transfers within the meaning of the Postal Services Act.<\/span><\/u><\/p>\n<p><span>The provision of Art. 25, para. 1, item 1 of the Ordinance states that, irrespective of documentation with a primary accounting document, a fiscal receipt from a fiscal device or a receipt from an IASMCA must be issued for every sale by the persons under Art. 3, para. 1 \u2013 for every payment <strong>with the exception of cases<\/strong> where the payment is made by depositing cash into a payment account, credit transfer, direct debit,<u> by cash money transfer or postal money transfer under Art. 3, para. 1.<\/u><\/span><\/p>\n<p><strong><span style=\"font-size: large;\">or \u2026. where the owner of an online shop has concluded a contract with the courier company for cash on delivery by postal money transfer:<\/span><\/strong><\/p>\n<p><span>1. For the payment made by a customer, the courier company issues a <strong>postal transfer receipt<\/strong> for the value of the amount due. <strong>This receipt is a document recognised by law which releases the trader from the obligation to issue a till receipt, as it serves that role.<\/strong><\/span><\/p>\n<p><span>2. The receipt is given to the customer once they have paid the amount to the courier in cash, and the sender receives a copy of it. <strong>The customer should attach the postal transfer receipt to the purchase invoices issued, on the basis of which to record their liability as paid in cash.<\/strong><\/span><\/p>\n<p><span>3. The amount collected by the courier from your customers i<strong>s transferred by the courier company to the trader&#8217;s bank account.<\/strong><\/span><\/p>\n<p><span>It should be noted that all this is possible and the issuing of a fiscal receipt is not required where there is a<strong> cash on delivery contract with postal money transfer<\/strong>, solely and only if the courier is a <strong>licensed postal operator<\/strong> for carrying out postal money transfers within the meaning of the Postal Services Act. Econt and Speedy are precisely such operators.<\/span><\/p>\n<p><span>The register is published on <u><span style=\"color: #000120;\"><a href=\"http_\/crc.bg_8080\/dpls\/apex\/f5797.html?p=923:230:356893147026401::NO:RP::\/\"> the website of the Communications Regulation Commission<\/a><\/span><\/u><br \/>\n<\/span><\/p>\n<p><strong><span>And so we should draw the conclusion that<\/span><\/strong><\/p>\n<p><span>1. When the company accepts a payment made in cash with cash on delivery, it becomes obliged to register and report the supplies by issuing a fiscal receipt.<\/span><\/p>\n<p><span>2.<strong> When the company has concluded a contract with a courier \u2013 a licensed postal operator \u2013 for cash on delivery with postal money transfer, the collected amounts are credited to the company&#8217;s bank account and it is not obliged to issue a fiscal receipt.<\/strong> The postal money transfer receipt issued by the courier upon receiving the amount from the customer serves as a till receipt. <\/span><\/p>\n<p><span>Legislation used:<\/span><\/p>\n<p><em><span>Ordinance No. N-18 of the Ministry of Finance of 13.12.2006<\/span><\/em><\/p>\n<p><span><span style=\"color: #000000;\">\u00a7 1 item <\/span>1. &#8220;delivery trade&#8221; is the sale of goods or services outside the commercial outlet upon prior order; the sale of newspapers and magazines for outlets specialised solely in newspapers and magazines is also considered delivery trade;<\/span><\/p>\n<p><span>Art. 25. (1) (Supplemented \u2013 SG, No. 40 of 2013, in force from 30.04.2013) Irrespective of documentation with a primary accounting document, a fiscal receipt from a fiscal device or a receipt from an IASMCA must be issued for every sale by the persons:<br \/>\n1.
